Package Description & Contents: A session of 2 hours shoot time. Clothing content and Props are at the discretion of the Client. No hair and make done by Photographer. Free digitals given to client no less than 5 photos but no guarantee of a number given. I give the client the right to use the photos anyway the client likes except for having them altered from the original state. This shoot falls under the MODELS AGREEMENT section please read carefully.

Entire Agreement: This agreement contains the entire understanding between Perfect Moments Photography stlmo and the CLIENT. It supersedes all prior and simultaneous agreements between the parties. The only way to add or change this agreement is to do so in writing, signed by all the parties. If the parties waive a portion of this agreement, the contract is not waived in its entirety. The party against whom a waiver is sought to be effective must have the waiver in writing.
Reservation: A signed contract and the package amount are required to reserve the specified coverage. A retainer amount of half the package session is due at time of booking to reserve the session and package for December 15, 2024. The remaining balance is due the day of the shoot.
Cooperation: The parties agree to cheerful cooperation and communication for the best possible result within the definition of this assignment.
Copyrights: The photographs produced by Perfect Moments Photography are protected by Federal Copyright Law (all rights reserved) and may not be reproduced in any manner without Perfect Moments Photography’s stlmo explicit written permission. It is a breach of this agreement to not only reproduce the images, but to display them on social networking sites and apps (Facebook.com, Instagram.com, etc.). If displayed on social networking sites, photos must say, “Photos by Perfect Moments Photography stlmo,” somewhere visible on the photo or on the information tab below each single photo. Upon image distribution or images purchased off your online web gallery, limited copyright ownership of the resulting images will be transferred to the CLIENT under the following conditions:
The photographic images are the property of CLIENT for personal use and for the purpose of the reproduction and giving of photographs to friends and relatives.
The CLIENT must obtain written permission from -- and compensate Perfect Moments Photography stlmo -- prior to the CLIENT or the CLIENT’S friends and relatives publishing or selling the photographs for profit.
Exhibition: Requests for photographic images to be used by Perfect Moments Photography stlmo may be requested at a future time. CLIENT grants Perfect Moments Photography stlmo permission to display images resulting from this assignment as an example of Perfect Moments Photography’s stlmo work and for entrance into photographic competitions and release all claims to profits that may arise from use of images.
If CLIENT’S photo is requested to be used in any print or online publication, they will discuss this with Perfect Moments Photography stlmo. Perfect Moments Photography stlmo grants CLIENT limited rights to use the images in marketing materials with specifications that photo by Perfect Moments Photography stlmo is listed on the image/article. If CLIENT requests to use the image in the distribution of products such as but are not limited to posters, clothing, etc., a 20% compensation rate of the total number of sales will apply unless otherwise agreed upon in writing.
Model Release: The CLIENT hereby grants Perfect Moments Photography stlmo and its legal representatives and assigns, the irrevocable and unrestricted right to use and publish photographs of the CLIENT or in which the CLIENT may be included, for editorial, trade, advertising, and any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same. The CLIENT hereby releases Perfect Moments Photography and its legal representatives and assigns from all claims and liability relation to said photographs.
Models Policy: If you are entering as a professional or amateur model or from a company that represents models YOU MAY receive 5 to 7 photos of your choosing and after that if any additional photos are wanted, they can be purchased from Perfect Moments Photography stlmo. The photographer may grant additional photos at NO COST but that is solely up to the photographer’s discretion. It is not implied that the photographer will grant additional photos. Models whether paid or doing TFP(time for photos) will still fall under the same rules and guidelines as a regular client in addition to the model guidelines presented here. If a model wants RAW files to be given an additional $10 dollars per photo will be paid for RAW files. Raw files come in whatever condition it was taken in and no editing or alterations will be done by the photographer. It is the models responsibility to contact the photographer about any additional styles, looks, services, prices and or times outside of what is agreed upon and will need to be discussed before the shoot date.
Limit of Liability: Perfect Moments Photography stlmo takes the utmost care with respect to exposure, transportation, and processing the photographs. However, in the unlikely event that photographs have been lost, stolen, or destroyed for reasons within or beyond Perfect Moments Photography’s stlmo control, Perfect Moments Photography stlmo liability is limited to the return of all payments received for the session package. The limit of liability for a partial loss of originals shall be a prorated amount of the exposures lost based on the percentage of total number of originals.
In the unlikely event that items are lost or stolen during the session, Perfect Moments Photography stlmo cannot be held liable.
Social Media Policy: You are free to share any of your photos on any social media platforms. Any photos shared that have been altered by “filters” or creative cropping will be a direct conflict of this contract and must be removed immediately. Any sharing done on social media must include credit to Perfect Moments photography stlmo in the caption, or a link to Perfect Moments Photography stlmo website/social media handle.
Extensive Editing Policy: It is standard that your photos be edited and provided to you in our agreed upon timeline with standard editing being done( light skin retouching, color changes). If the CLIENT requests more extensive editing(body changes, background changes etc: Editing can be but is not guaranteed for a fee up to $30 per photo, to be paid prior to any additional editing being completed if it is within the photographers skill of doing.
Weather Policy: In the event of weather conditions out of our control:
Due to photography equipment and lighting conditions, it is the photographer’s discretion if weather conditions are such that the session must be cancelled. If such an event occurs, you will be given the opportunity to reschedule for the next available date. If the CLIENT pursues the session, regardless of the photographer’s advice, and the images are not up to Perfect Moments Photography’s stlmo standards, the CLIENT will be responsible for all charges related to scheduling an additional shoot.
Cancellation and Rescheduling Policy: If you must cancel, Perfect Moments Photography stlmo must be notified 3 days prior to the session date to qualify for a reschedule. The rescheduled date will be made as soon as possible, at the photographer’s discretion. If notification is not made 3 days prior, your session retainer will be forfeited.
Props: The CLIENT is responsible for bringing any props that they would like in their photos. If the CLIENT has forgot a prop for the session and wants photos with that prop, the CLIENT will be charged for an additional session at the photographer’s hourly rate to reschedule or shoot additional photos.
Appearance: If the CLIENT would like additional photos due to appearance out of the photographer’s control (hair/makeup, etc.) in the session, the CLIENT will be charged for an additional session at the photographer’s hourly rate to reschedule or shoot additional photos.
Free Will and Consent: CLIENT agrees that all poses, positions, and situations within the session are covered in the release or entered into without force, coercion, or threat. CLIENT agrees to hold Perfect Moments Photography stlmo blameless and free of all accusation of such force. CLIENT agrees that all poses were willfully done. CLIENT agrees and understands that they are not to be under the influence of any drugs, narcotics, alcohol, or any other substance during the duration of the session as this is not allowed due to the nature of these sessions.
Extenuating Circumstances: If a session is being done and Perfect Moments Photography stlmo becomes uncomfortable due to CLIENT requests or props that were not agreed upon in prior written communication, Perfect Moments Photography stlmo has the right to end the session immediately and CLIENT will forfeit the full package amount.
Locations: If the CLIENT wishes to include multiple locations in addition to the package, there will be a fee of $30 per location change. Perfect Moments Photography will be notified 14 days in advance of all the locations, directions, and addresses. Note that the additional travel time incurred will be included in the total session time.
Location Access and Fees: If the CLIENT chooses a location which charges admission, an access fee, a parking fee, or a photography fee, the CLIENT will be responsible to cover those fees associated with shooting at those locations. The CLIENT will also be responsible for organizing access and any permits related to doing so.
Additional Members: Sessions are limited times and are meant to include CLIENT only. In the event that the CLIENT wants to add additional family members/friends in the session, they will be a required $50 fee per person, as well as a signed model release at the time of the session.
Outfits: There are unlimited outfit changes included in this session. There will be a $0 fee for any additional outfit changes desired.
What to Wear: BEFORE YOUR Photo Shoot (just advice)
• Look at a few different outfits, around 3-6 Should be enough. Whatever wardrobe you pick should make you feel fabulous, I just want you to feel your best. . If You want a particular theme for the photoshoot , we can discuss it. Most of all, I want your personality to shine and for you to feel your best! (If we are shooting on location, please bring appropriate outerwear)
•The night before, drink as little alcohol as you can and getting some rest. Your face will love you for that. When you get up, EAT! It takes a lot of energy to model for the day, so please at least bring a snack and some water with you!
• Please come prepared with hair and makeup ready or IF we are getting your hair and makeup done, a clean, exfoliated face for makeup is golden. Hair styles should be mostly completed before arrival but there is time for touchups and help with that before the photoshoot.
• If you want to have your hair, nails, or any waxing done, make sure to do this 2-4 days before your session.
• Wear loose fitting underwear/bra and clothes so there are no lines on your skin and if this is a Boudoir shoot wear new underwear and clothes. Always remember comfort is just as good as style.
• Breath deep and slow, you are going to have a great photoshoot!

Tardiness: If the CLIENT is late to the appointment set, the CLIENT’S session will still be for the same scheduled ending time. The photographer will wait at the agreed upon meeting location until 15 minutes after the session start time. In the event that the CLIENT does not arrive within 15 minutes of the session time and date, they will be required to purchase an additional session package for another session if they choose to shoot with the photographer. NO REFUNDS ARE GIVEN AFTER THIS TIME.
Security Retainers: In the event of cancellation, the retainer amount is non-refundable. It shall be liquidated damages to Perfect Moments Photography in the event of a breach of contract by CLIENT. The CLIENT shall also be responsible for payment of any Perfect Moments Photography material charges incurred up to the time of cancellation. If CLIENT needs to reschedule for any reason, CLIENT must do so within 4 calendar days of the shoot and any retainer or paid fees will be transferred to the rescheduled session. Any request for reschedule after 4 calendar days before the shoot will require a $70 rescheduling fee up to 4 calendar days.
Completion Schedule: Editing and image delivery takes approximately one to five weeks in most cases but may take longer. If image delivery is outside of this time, the CLIENT will be notified via email before the due date.
